Canada: Spousal and partner sponsorship: refusal reasons and the fix

Canada Spousal and partner sponsorship, government fee CAD 1,260 per spouse; verified against canada.ca. The route page carries the eligibility test, fees, timeline and document checklist these reasons refer to.

Relationship not genuine or entered into for immigration

The officer found inconsistencies between IMM 5532, the interview and the evidence: few meetings before marriage, no shared finances, communication that started only around the wedding, or a previous sponsorship pattern.

The fix. Build a chronological evidence file that covers the whole relationship, explain cultural context for an arranged marriage in a joint statement, prepare both spouses for the interview on dates and family details, and seek legal advice before reapplying or appealing to the Immigration Appeal Division.

Sponsor ineligible

The sponsor was on social assistance, in default of a previous undertaking or support order, undischarged bankrupt, or had been sponsored as a spouse within the past five years.

The fix. Clear the default or wait out the bar, then reapply; the five-year rule cannot be waived.

Misrepresentation

An undeclared previous marriage, a child omitted from IMM 5406, or documents that did not verify. A section 40 finding bars the applicant for five years and can affect the sponsor.

The fix. Declare every marriage, child and refusal on every form, including non-accompanying children, and use certified translations of registered documents.

Applicant inadmissible

A conviction, a medical condition expected to place excessive demand (spouses are exempt from excessive demand but not from danger to public health) or a security concern.

The fix. Obtain the criminal rehabilitation or record suspension before filing; complete the medical upfront and respond to any procedural fairness letter with specialist reports.

Incomplete or inconsistent application

Missing police certificate, unsigned form or different dates for the same event across forms led to a return or refusal.

The fix. Use the IRCC document checklist line by line, have both spouses review every form together, and keep one timeline document that every answer is drawn from.

United Kingdom: Spouse and partner visa: refusal reasons and the fix

United Kingdom Spouse and partner visa, government fee £2,064 per applicant; verified against gov.uk. The route page carries the eligibility test, fees, timeline and document checklist these reasons refer to.

Financial evidence not in the Appendix FM-SE format

A pay slip or a statement missing from the six months, salary paid in cash, or the employer letter lacking a required statement, so the income was not counted even though it was earned.

The fix. Work from the FM-SE checklist line by line; every pay slip must match a bank credit, and the employer letter must confirm employment, salary, contract type and that the pay slips are genuine.

Relationship not genuine and subsisting

Few meetings before and after the wedding, inconsistent accounts of how you met, no evidence of communication over time.

The fix. Build a chronological bundle covering the whole relationship with a short index, include both partners' statements, and explain cultural context where the marriage was arranged.

English evidence not accepted

A non-SELT test, an expired certificate or a degree without an Ecctis statement.

The fix. Book IELTS Life Skills A1 or another SELT at an approved centre and keep the result within its two-year validity.

Accommodation inadequate or unproven

No tenancy or landlord consent, or a shared house without a property inspection report.

The fix. Provide the tenancy or mortgage statement, a landlord letter permitting the applicant to live there, and an inspection report from the council or a qualified surveyor.

Immigration history or deception

An undeclared refusal or an unverifiable document brings a refusal under the suitability rules and, for deception, a ban of up to ten years.

The fix. Declare every refusal with the letter, use documents the issuer will confirm, and take advice before reapplying after any deception finding.

Australia: Partner visa: refusal reasons and the fix

Australia Partner visa, government fee AUD 11,710 main applicant; verified against immi.homeaffairs.gov.au. The route page carries the eligibility test, fees, timeline and document checklist these reasons refer to.

Relationship not genuine and continuing

Thin evidence under one or more pillars, inconsistencies between the partners' statements and the documents, or long periods apart without evidence of contact.

The fix. Build a chronological file with evidence under each pillar, align both statements to one timeline, explain cultural context for arranged marriages, and include Form 888 declarations from people who know the couple.

De facto period not met

Fewer than 12 months of cohabitation evidence and no registered relationship or compelling circumstances.

The fix. Register the relationship in an Australian state where possible, or wait until 12 months of shared-address evidence exists before lodging.

Sponsor ineligible or limitation

The sponsor had already sponsored two partners, sponsored one within the last five years, or had relevant convictions.

The fix. Check sponsor limitations before lodging; a waiver for compelling circumstances is possible but must be argued with evidence.

Public interest criterion 4020 or character

A false document, an undisclosed previous marriage or an undeclared conviction by either party.

The fix. Declare everything, use only verifiable documents and attach court records where there is a conviction.

Health requirement

A medical condition assessed as a significant cost to the Australian community without a waiver being considered.

The fix. Complete examinations early and take advice on the health waiver that applies to partner visas.

United States: Family immigrant visa: refusal reasons and the fix

United States Family immigrant visa, government fee USD 325 per applicant; verified against travel.state.gov. The route page carries the eligibility test, fees, timeline and document checklist these reasons refer to.

Thin evidence, inconsistent answers at the interview, long periods apart with no contact evidence, or a marriage shortly after another immigration refusal.

The fix. Build a chronological relationship bundle, prepare both spouses on the same facts, and explain arranged-marriage customs and time apart with evidence of continuing contact.

The fix. Take legal advice on the I-601 waiver, which requires extreme hardship to the US citizen or resident spouse or parent.

Petition problems

An earlier marriage not legally ended, or a petitioner who became a citizen after filing without updating the category.

The fix. Obtain the decree and refile or request reclassification; immediate-relative upgrades remove the F2A wait.

The fix. Pass Start Deutsch 1 or submit the sponsor's Blue Card or skilled worker permit to claim the exemption.

The sponsor's income was below the standard for the household or the flat was too small.

The fix. Submit the contract and pay slips showing secure income, and a tenancy for a flat that meets the local size rule.

The fix. Provide a chronological relationship file and prepare both spouses for separate interviews on the same facts.

The fix. Complete the transcription first, submit apostilled and translated documents, and prepare both spouses for the interview on the same facts.

Family reunification conditions not met

Sponsor's income below the SMIC, housing too small, or less than 18 months' residence.

The fix. Wait until the conditions are met or, if the sponsor can obtain a talent card, switch to the talent-family route.
