Canada: Work permit: refusal reasons and the fix
Canada Work permit, government fee CAD 155 per person; verified against canada.ca. The route page carries the eligibility test, fees, timeline and document checklist these reasons refer to.
Not qualified for the job offered
Education or experience letters did not match the requirements in the LMIA or the NOC duties; the officer doubted you could perform the work.
The fix. Obtain detailed experience letters that mirror the NOC lead statement and main duties, add an educational credential assessment and any licensing eligibility letter.
Genuineness of the job offer
The employer's size, revenue or history did not support the role, or the wage was below the stream threshold, so the officer questioned whether the job existed as described.
The fix. Employers should keep the LMIA file complete (business registration, payroll, premises) and offer at least the median wage plus 20 percent; workers should request a copy of the full LMIA before filing.
Not satisfied you will leave Canada
Weak ties, family in Canada and no explanation of plans after the permit.
The fix. Declare dual intent, then document ties and a plan: property, dependants, savings and the employer's statement of the contract term.
LMIA expired or refused to process
The LMIA was used after its six-month validity or Service Canada refused to process a low-wage application in a 6-percent-unemployment region.
The fix. File the permit within the LMIA validity window; employers in affected regions move the role to the high-wage stream or an exemption category before re-advertising.
Misrepresentation
A recruiter supplied an experience letter the employer did not issue, or an earlier refusal was not declared. Section 40 findings bring a five-year ban.
The fix. Verify every letter with the issuer, declare all refusals and never pay a recruiter for an LMIA; report demands for payment to Service Canada.
United Kingdom: Skilled Worker visa: refusal reasons and the fix
United Kingdom Skilled Worker visa, government fee £819 per person (up to 3 years); verified against gov.uk. The route page carries the eligibility test, fees, timeline and document checklist these reasons refer to.
Salary below the threshold or the going rate
The CoS salary was under £41,700, under the going rate for the occupation code, or pro-rated hours took it below the threshold.
The fix. The sponsor reissues the CoS at a compliant salary for the hours stated; check the going-rates table for the code before the offer is made.
Occupation not eligible at the skill level
The job was coded to a medium-skilled occupation not on the Immigration Salary List or the Temporary Shortage List, or the duties did not match the code chosen.
The fix. Re-examine the duties against the SOC 2020 descriptions; use the correct higher-skilled code only if the duties genuinely fit, otherwise the role cannot be sponsored.
English not proven at B2
An older B1 result, a non-SELT test or a degree without an Ecctis statement.
The fix. Take a SELT at B2 or obtain the Ecctis English proficiency statement before applying.
Genuineness of the vacancy or sponsor compliance
UKVI doubted the role existed as described, or the sponsor's licence was downgraded or suspended during processing.
The fix. Employers keep job descriptions, organisation charts and right-to-work records in order; workers should check the sponsor's licence rating on the register before accepting an offer.
Maintenance, TB or criminal record evidence missing
Savings not held for 28 days without sponsor certification, an expired TB certificate, or no police clearance for a listed occupation.
The fix. Ask the sponsor to certify maintenance on the CoS, book the TB test within six months of applying, and request police certificates early; Indian PCCs take two to four weeks.
Australia: Skills in Demand visa: refusal reasons and the fix
Australia Skills in Demand visa, government fee AUD 4,015 per person; verified against immi.homeaffairs.gov.au. The route page carries the eligibility test, fees, timeline and document checklist these reasons refer to.
Salary below the threshold or the market rate
The nominated earnings were below AUD 79,423 or below the annual market salary rate for the role in that location, so the nomination was refused and the visa with it.
The fix. The employer reissues the nomination at a compliant salary supported by market evidence; check the indexed threshold each 1 July.
Insufficient or unmatched experience
Letters did not show one year of full-time relevant experience, duties did not match the ANZSCO description, or the work was part time.
The fix. Obtain detailed letters that mirror the ANZSCO tasks with hours and dates, and add pay slips, Form 16 and PF statements to corroborate.
Skills assessment or registration missing
The occupation required a skills assessment or state registration for Indian applicants and none was held at lodgement.
The fix. Check the occupation's requirements on the Core Skills Occupation List page and complete the assessment before lodging; allow 4 to 12 weeks.
Genuine position or sponsor compliance
Home Affairs doubted the role was genuine and full time, or the sponsor had unmet obligations from earlier sponsorships.
The fix. Employers keep organisation charts, job descriptions and payroll evidence in order and resolve monitoring issues before nominating; workers check the sponsor's standing before accepting.
English, health or character
A test below 5.0 in a band, an expired test, an incomplete health examination or an undeclared conviction.
The fix. Retake the test within validity, complete examinations before lodging and disclose all convictions with court records.
United States: H-1B specialty occupation visa: refusal reasons and the fix
United States H-1B specialty occupation visa, government fee USD 205 per person; verified against travel.state.gov. The route page carries the eligibility test, fees, timeline and document checklist these reasons refer to.
Not selected in the lottery
Registrations exceed the cap every year; with wage weighting, level I offers have the lowest odds.
The fix. Ask the employer to classify the role honestly at the highest supportable wage level, hold a US master's where possible, or look at cap-exempt employers, L-1 transfers and O-1 for exceptional ability.
Specialty occupation not established (RFE or denial)
USCIS found the job does not require a specific degree, or the degree is unrelated to the duties.
The fix. Document the degree requirement with the job description, industry practice, the employer's hiring history and expert letters; align the SOC code with the duties.
Employer-employee relationship or itinerary at third-party sites
Consulting placements without client letters, contracts and work orders showing control and non-speculative work.
The fix. Provide the contract chain, client letter and an itinerary covering the petition period.

The fix. Bring the full petition copy, client letter and pay slips, respond to the request immediately, and avoid non-refundable travel until the visa is issued.

The offer was under €50,700, or under €45,934.20 where the lower threshold applied.
The fix. Renegotiate the offer or apply as a skilled worker at the market salary with Federal Employment Agency approval.
